TERMS AND CONDITIONS
(NO PURCHASES NECESSARY TO ENTER OR WIN THIS CONTEST; VOID WHERE PROHIBITED)
Entry in “The Biggest Fan of TBDBITL” Contest (the “Contest”) starts at 6 a.m. EST on April 5, 2018 and ends at 11:59 p.m. EST on April 30, 2018 (the “Entry Period”). The sponsor of this Contest is The Ohio State University Foundation, 1480 W. Lane Avenue, Columbus, OH 43221 (the “Sponsor”). The Contest shall be subject to these Terms and Conditions, and by entering all participants agree to be bound hereby.
ELIGIBILITY:
The Contest is open to legal residents of the United States who have reached the age of majority in their jurisdiction of residence as of the first date of the Entry Period. Faculty, staff, interns, board members, directors, and officers of The Ohio State University and The Ohio State University Foundation, as well as their immediate family (including spouse, parents, siblings, and children) and their respective household members, are not eligible for the Contest.
The Sponsor has the absolute right to adjust the scores of, or disqualify, those individuals who are ineligible to enter, those individuals whose fundraising page contains multiple donations from one or more donors, those individuals whose fundraising page contains a donation made by the individual, and those individuals who otherwise violate these Terms and Conditions. All decisions made by the Sponsor in connection with this Contest, including without limitation, decisions related to eligibility requirements, are final and binding.
HOW TO ENTER THE CONTEST:
During the Entry Period, you may enter the Contest by creating a fundraising page on everydayhero, The Ohio State University’s Personal Fundraising Platform available here. Each individual may only create one fundraising page and may not make donations to their own fundraising page.
HOW TO WIN:
The winner of the Contest will be the individual who receives the highest number of unique donors to their fundraising page during the Entry Period, regardless of the total amount raised. For instance, an individual whose fundraising page received $500 in donations from 50 separate donors, is placed above an individual who received $500 in donations from 10 donors. The Contest will result in only one (1) winner. It is the Sponsor’s sole discretion to calculate the number of unique donors. All decisions made by the Sponsor in connection with this Contest, including without limitation, decisions related to scoring, are final and binding.
WINNER NOTIFICATION AND REQUIREMENTS:
The winner will be notified via email. Once notified, the winner will have 48 hours to claim their award. The winner must also sign and return a completed W-9 form to the Sponsor along with a release and acknowledgement of the terms and conditions of the award. Failure to claim the award within 48 hours or failure to return the W-9 form or the release and acknowledgement of the terms within 14 days may result in forfeiture of the award. Sponsor may also require, except where prohibited, a potential winner to complete and return an affidavit of eligibility, including proof of age.
PRIZE:
The Sponsor will award one (1) prize, the Ultimate TBDBITL Experience (the “Experience”). The Experience consists of one (1) trip to New York, New York for the 2018 Macy’s Thanksgiving Parade for two (2) people, including the Contest winner and his/her travel companion, for four (4) days and three (3) nights during the specific dates of 11/20/2018 to 11/23/2018. The Experience includes the following: (i) roundtrip (“R/T”) airfare for two (2) from any major U.S. airport nearest the Contest Winner’s location (as selected by the Sponsor) to either John F. Kennedy International Airport or LaGuardia Airport; (ii) three (3) consecutive nights hotel accommodations (single standard room, double occupancy, room and tax only) at a hotel selected by the Sponsor; and (iii) entry into the VIP PARADE VIEWING EVENT & BRUNCH at Jimmy’s American Grill to watch TBDBITL’s first performance in the Macy’s Thanksgiving Day Parade (as selected by Sponsor and subject to change). The approximate retail value (“ARV”) of the Experience is $5,060. If necessary, due to unavailability for any reason, a comparable prize will be awarded at the sole discretion of the Sponsor. All federal, state and local tax liabilities are the responsibility of the winner.
The Contest winner is subject to the following additional conditions and limitations, which may be modified at any time by Sponsor or its designee, at Sponsor’s sole discretion.
All travel arrangements are to be administered by Sponsor or its designee(s). The Sponsor or its designee has sole discretion in selecting the specific air carrier(s) and arranging any and all aspects of the Experience, including accommodation arrangements. The actual value of the Experience may vary depending on the city of departure, date and times of travel, airfare fluctuations and hotel charges at the time of the travel bookings. Any difference between actual value and stated ARV (if actual value is lower than stated ARV) will not be awarded. The contest winner must be able to travel during the dates specified above. If the contest winner is unable to travel during the dates specified, the Prize will be forfeited in its entirety, and a substitute prize may be awarded at the Sponsor’s sole discretion. All meals, ground transfers, gratuities, excursions, insurance, incidentals, and any other expenses not specified herein are the sole responsibility of the Contest winner and his or her respective travel companion. Nor shall Sponsor be responsible for any injury or loss that may occur during or as a result of the Contest, including the Experience. All travel must originate and end at the same major U.S. airport. The Contest winner and his or her travel companion will be required to provide a valid government issued photo ID as required by travel authorities at the time of travel. No changes will be made to travel details or itinerary once any element(s) of such travel arrangements have been booked. No frequent flyer miles will be earned on any element of prize travel. Sponsor will not replace lost or stolen tickets, travel vouchers, or certificates. All travel is subject to availability, capacity controls, blackout dates and certain other restrictions, all of which are subject to change. No stopovers are permitted on tickets issued as a part of the experience; if a stopover occurs, the Experience will terminate and full fare will be charged from the stopover point for the remaining Experience segments, including the return. Once hotel and flight arrangements have been confirmed, no changes will be allowed expect by Sponsor or its designee. If unclaimed, the Experience, or portion thereof, will remain the property of the Sponsor or its designee.
PUBLICITY:
Acceptance of the prize constitutes permission (except where prohibited) for the Sponsor and its designee(s) to use the winner’s name, likeness, biography, statements, voice, image and any other personal characteristics, in any and all media now or hereafter known, for any purpose, including without limitation, marketing, promotional and publicity purposes without additional compensation to each such individual, and each such individual hereby releases Sponsor and its designee(s) from any liability with respect to such use.
WINNER ANNOUNCEMENT:
The winner will be announced in an email to all participants on May 4, 2018. The email will also contain the overall campaign numbers.
GENERAL CONDITIONS:
In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the Prize from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Terms and Conditions, or acts in a disruptive, unethical or unsportsmanlike manner. Sponsor’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of a fundraising page, the authorized account holder of the e-mail address used to create the fundraising page will be deemed to be the owner. Moreover, a potential winner may be requested to provide Sponsor with proof that the potential winner is the individual associated with the potential winning fundraising page and that all eligibility requirements are met. The Contest is subject to all federal, state, and local laws and regulations and is void where prohibited.
RELEASE AND LIMITATIONS ON LIABILITY:
By entering the Contest, you agree to release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, including The Ohio State University, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) printing errors; (d) late or undelivered email or notice; (e) errors in the administration of the Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorneys’ fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
PRIVACY:
Any information you submit as part of the Contest will be used in accordance with Sponsor’s Privacy Policy which can be found here. The information you provide when you enter is provided to Sponsor.
